1. General Disclaimer

1.1. The information, tools, data, and content provided through the MNH Expert platform ("Platform") are general in nature and are provided for informational and professional assistance purposes only.

1.2. Nothing on the Platform constitutes, or should be construed as, personal financial advice, financial product advice, a recommendation, or an offer to buy or sell any financial product.

1.3. MNH Planning Administration Pty Ltd ("MNH") does not hold an Australian Financial Services Licence (AFSL) and is not an authorised representative of any AFSL holder. MNH provides software tools to assist licensed financial professionals -- it does not provide financial advice.

1.4. Users should not act on any information provided by the Platform without first obtaining independent professional advice appropriate to their circumstances.


2. Artificial Intelligence Disclaimer

This section is critical for Users of the Platform's AI-powered tools, including Statement of Advice generation, research outputs, fund comparisons, and engagement widgets.

2.1. AI Tools Are Assistive, Not Advisory. The Platform's AI tools are designed to assist licensed financial advisers in the preparation and drafting of advice documents. AI tools do not provide financial advice, and their outputs must not be treated as finalised advice.

2.2. All AI Outputs Are Drafts. Every document, analysis, comparison, summary, or other output generated by the Platform's AI tools is a draft only. AI-generated content may contain:

  • (a) factual errors or inaccuracies;
  • (b) hallucinated information (content that appears plausible but is fabricated);
  • (c) outdated information that does not reflect current market conditions, legislation, or regulatory requirements;
  • (d) incomplete analysis that omits material considerations; and
  • (e) formatting or structural issues that do not meet licensee requirements.

2.3. No Warranty on AI Accuracy. MNH makes no warranty, representation, or guarantee as to the accuracy, completeness, reliability, suitability, or timeliness of any AI-generated content. The Platform's AI tools utilise large language models (including Anthropic Claude) which, by their nature, may occasionally produce incorrect, misleading, or inappropriate information.

2.4. Mandatory Professional Review. The licensed financial adviser (or their authorised representative) must:

  • (a) review all AI-generated content in its entirety before use;
  • (b) verify all factual claims, data points, calculations, and regulatory references;
  • (c) ensure the content complies with the Corporations Act 2001 (Cth), the relevant AFSL conditions, and the licensee's internal compliance requirements;
  • (d) make all necessary amendments to ensure the advice is appropriate for the individual client; and
  • (e) take full professional responsibility for any advice document provided to a client, regardless of whether it was generated with the assistance of AI tools.

2.5. AI Model Limitations. Users acknowledge that AI models are probabilistic in nature and that outputs may vary between requests, even for identical inputs. MNH does not guarantee consistency of AI outputs.


3. Professional Responsibility

3.1. MNH provides tools, not advice. The Platform is a professional productivity tool. The responsibility for all financial advice, financial product advice, and client communications rests entirely with the AFSL holder and their authorised representatives.

3.2. The AFSL holder or authorised representative is solely responsible for:

  • (a) ensuring compliance with the Corporations Act 2001 (Cth) and all applicable regulatory requirements;
  • (b) meeting the best interests duty and related obligations;
  • (c) providing advice that is appropriate to each client's individual circumstances;
  • (d) maintaining adequate professional indemnity insurance;
  • (e) ensuring all outputs from the Platform comply with their licensee's policies, procedures, and compliance requirements; and
  • (f) supervising staff members who use the Platform.

3.3. MNH accepts no responsibility or liability for any financial advice, financial product advice, or other professional advice provided by Users to their clients, whether or not such advice was prepared with the assistance of the Platform.


4. Data Accuracy Disclaimer

4.1. The Platform provides fund data, tax rates, Centrelink rates, and other financial data sourced from public sources including:

  • (a) the Australian Prudential Regulation Authority (APRA);
  • (b) the Australian Taxation Office (ATO);
  • (c) the Reserve Bank of Australia (RBA); and
  • (d) other government, regulatory, and publicly available sources.

4.2. While MNH endeavours to ensure the accuracy and timeliness of data published on the Platform, MNH does not warrant that any data is accurate, complete, current, or error-free. Data may be subject to delays between publication by the source and availability on the Platform.

4.3. Fund scoring, comparisons, and rankings are generated using MNH's proprietary methodologies and are provided for informational purposes only. They do not constitute investment recommendations or endorsements of any financial product.

4.4. Users must independently verify all critical data before relying on it for any purpose, including the preparation of advice documents, product comparisons, or client communications.

4.5. MNH is not responsible for any errors, omissions, or inaccuracies in data sourced from third-party providers.


5. Third-Party Content and Services

5.1. The Platform may contain links to, or integrations with, third-party websites, services, and content. MNH does not endorse, control, or accept responsibility for any third-party content or services.

5.2. The Platform integrates with third-party services including email providers (Gmail, Microsoft 365), cloud infrastructure providers, and AI model providers. MNH is not responsible for the conduct, availability, or performance of these third-party services.

5.3. Users access third-party services at their own risk and should review the applicable terms and conditions of those services.


6. Copyright and Permitted Use

6.1. All content on the Platform, including but not limited to text, graphics, logos, software, data compilations, and documentation, is the copyright of MNH Planning Administration Pty Ltd unless otherwise stated. All rights are reserved.

6.2. Users may print or download content from the Platform for their own professional use in connection with their financial planning practice.

6.3. Users must not:

  • (a) reproduce, distribute, or publicly display MNH's content for commercial purposes without MNH's prior written consent;
  • (b) use MNH's content in a manner that competes with MNH's business; or
  • (c) remove or alter any copyright notices, trademarks, or other proprietary markings from MNH's content.

7. Limitation of Liability

7.1. To the fullest extent permitted by law, including under the Competition and Consumer Act 2010 (Cth), Schedule 2 (Australian Consumer Law), MNH excludes all liability for any loss, damage, cost, or expense (whether direct, indirect, incidental, special, consequential, or otherwise) arising from or in connection with:

  • (a) reliance on any information, data, or AI-generated content provided through the Platform;
  • (b) any errors, inaccuracies, or omissions in data or AI-generated content;
  • (c) any decisions made or actions taken based on information obtained from the Platform;
  • (d) any interruption, suspension, or termination of the Platform or any part thereof; and
  • (e) any unauthorised access to or use of User data, except to the extent caused by MNH's gross negligence or wilful misconduct.

7.2. Where the Australian Consumer Law implies guarantees that cannot be excluded, MNH's liability for breach of any such guarantee is limited, at MNH's election, to:

  • (a) the re-supply of the services; or
  • (b) the payment of the cost of having the services re-supplied.

7.3. Nothing in this Disclaimer excludes or limits liability that cannot be excluded or limited by law.


8. Changes to This Disclaimer

8.1. MNH may update this Disclaimer from time to time. The updated version will be published on the Platform with a revised "Last Updated" date.

8.2. Users are encouraged to review this Disclaimer periodically. Continued use of the Platform following publication of changes constitutes acceptance of the updated Disclaimer.
